Terms & Conditions
The terms that apply when you request, approve, or receive services from True North Outdoor Solutions.
By requesting, approving an estimate for, or receiving services from us, you ("you," "the customer") agree to these Terms.
1. Services
We provide residential and commercial outdoor property services, which may include lawn cutting, fertilization, weed control, aeration (core and liquid), overseeding, landscaping and hardscaping (garden design, planting, mulch, sod, interlock, retaining walls), property maintenance (spring and fall cleanups, hedge trimming, gutter clean-out, junk removal), power washing, and snow & ice services. The specific services, scope, and price for your property are set out in the estimate/quote we provide and that you approve.
2. Estimates, quotes and pricing
- Estimates are based on the information available and the property conditions at the time of quoting. Prices are valid for 30 days unless stated otherwise.
- If actual conditions differ materially from what was quoted (e.g., property size, terrain, overgrowth, access), we will notify you and, where practical, seek your approval before proceeding with additional work or charges.
- Prices are in Canadian dollars and exclude applicable taxes unless stated. Sales tax is applied at the rate for the province where the work is performed.
3. Scheduling, access and your responsibilities
- We schedule services within a target window; exact timing may shift due to weather, prior jobs, or conditions beyond our control.
- You are responsible for providing safe, unobstructed access to the areas to be serviced on the scheduled date (unlocked gates, secured pets, cleared debris, gate codes provided in advance).
- If we cannot access or safely perform the work through no fault of ours, a trip/re-visit charge may apply.
4. Property condition, hidden items and liability
- You must flag hidden or unmarked items before work begins — including irrigation/sprinkler lines, invisible dog-fence wiring, low-voltage/landscape cabling, septic components, décor, and fragile features. We are not responsible for damage to items that were not marked or disclosed.
- We take reasonable care and, where relevant, document pre-existing property conditions (e.g., photos).
- We carry liability insurance; a certificate is available on request.
- To the fullest extent permitted by law, our liability for any claim relating to our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be excluded under applicable consumer-protection law (including the Ontario Consumer Protection Act, 2002 and Quebec's Consumer Protection Act).
5. Pesticide, herbicide and chemical applications
- Weed control, fertilization and similar applications are performed in accordance with applicable federal and provincial law and product label directions, by appropriately licensed personnel where required.
- We will provide any legally required notices and post signage where applicable. Please keep children and pets off treated areas for the period stated on the product/notice.
6. Satisfaction, warranties and re-service
- If you are not satisfied with a completed service, tell us within 48 hours and we will make reasonable efforts to correct it. See our Refund & Satisfaction Policy.
- Results of horticultural services (e.g., seeding, fertilization, pest control) depend on factors outside our control (weather, watering, soil, pest pressure). We do not guarantee specific biological outcomes unless expressly stated in writing.
7. Payment
- Payment is due as stated on your invoice. We accept e-transfer and, where offered, card payment.
- Late or unpaid balances may be subject to a late fee and/or suspension of service, and may be referred for collection. You are responsible for reasonable collection costs permitted by law.
8. Cancellation and rescheduling
- You may cancel or reschedule a visit at no charge with at least 24 hours' notice. Late cancellations or missed appointments may incur a fee.
- Either party may end an ongoing/seasonal service arrangement with reasonable notice; you remain responsible for services already performed.
9. Photos and records
We may take before/after photos of the work for quality, record-keeping, and dispute-resolution purposes. We will not publish identifiable images of your property for marketing without your consent.
10. Communications and consent
By providing your contact information you agree we may contact you about your service, scheduling, and account. Marketing emails/texts are sent only with your consent, and you can unsubscribe at any time (see our Privacy Policy).
11. Dispute resolution and governing law
These Terms are governed by the laws of the Province of Ontario or, where the work is performed in Quebec, the Province of Quebec, together with the applicable laws of Canada. The parties will attempt to resolve disputes in good faith before pursuing other remedies.
12. Changes to these Terms
We may update these Terms; the version in effect when you approve an estimate applies to that work. The current version is available at truenorthoutdoorsolutions.com/terms.
